Turcultur - Turismo e Cultura de Portugal, Lda., ("Turcultur") in the context of the services developed at Quake needs to collect and process personal data of its customers.  

The use of the Quake website, online shop and the very visit to Quake implies the collection of personal information of its users, in order to provide a complete experience during the visit and after it. 

In this sense, the present privacy policy and protection of personal data ("Privacy Policy") aims to elucidate our customers and users (hereinafter, "Customers") to understand what types of personal data we collect and what is the purpose of its collection and use.  

This Privacy Policy aims to comply with the general rules regarding privacy and the processing of personal data collected in strict compliance with the legislation in force in this field, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("General Data Protection Regulation" or "GDPR"), Law No. 58/2019 of 8 August (Ensures the implementation, in the national legal order, of Regulation (EU) 2016/679 of the European Parliament and of the Council. 

The use of our website and online shop and the provision of data directly or indirectly implies knowledge and acceptance of the conditions of the Privacy Policy, the General Terms and Conditions of Use and any other specific terms, policies and conditions.

In which cases does the Privacy Policy apply?

This privacy policy applies to all cases of contract between the Customer and Turcultur. It also applies to cases where the Customer books his or her ticket, even through a third party.

Who is responsible for the processing of personal data?

The entity responsible for the processing of personal data is Turcultur - Turismo e Cultura de Portugal, Lda, collective entity no. 514 183 152.

What is personal data?

Personal data shall mean any information of any nature whatsoever, irrespective of the medium used, concerning an identified or identifiable natural person. 

An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, electronic identifiers, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

What personal data do we collect?

Turcultur collects and processes personal data necessary for the provision of its services or to manage your contacts with us. 

Through the website the following personal data may be collected: (i) name; (ii) identification data; (iii) contact data (telephone, e-mail); (iv) bank details or other data (e.g. booking number) or information on how you use our pages. 

Turcultur is especially concerned with the protection of the rights of minors, so the collection of personal data of minors under 13 years of age is dependent on the consent of their parents / representatives of the minor. Therefore, when collecting data from minors, we will request the e-mail address of the parents / representatives of the minor to confirm that they consent to the processing of personal data of the minors in question.

What are the purposes of the collection of personal data?

The personal data of the Customers are used in the context of the provision and management of services contracted or booked, as well as for the study, improvement and adequacy of services to the needs and interests of the Customer, namely to expedite the processes of booking tickets or purchasing Quake products. 

The Client may, however, provide their personal data for other purposes, including receiving institutional information from Quake, to receive marketing communications (promotions and campaigns of our products and services), as well as sending complaints and suggestions. 

Through this Privacy Policy, the Customer consents to photographs and videos being taken during your visit and experience at Quake, so that, regarding the photographs, if you so wish, you can purchase them later as a souvenir of the experience. The video records will be used for security purposes, framed in the video surveillance circuit of the building.

Reservation management and service provision

When you visit Quake, we use the information provided to us to provide our services in relation to your ticket purchase, for example, to issue your ticket.

Customer relationship management

Turcultur may contact the Client via SMS or email for administrative or operational reasons, such as to send you communications regarding bookings, purchases and payments or to inform you of the need to make changes to your visit. 

Since these communications are intended for marketing purposes you will continue to receive them even if you have opted out of receiving marketing communications. 

The Customer's personal data will also be used to respond to requests, suggestions, contacts.

Information on news and offers of interest to you

Turcultur may send you marketing communications if the Customer indicates that he wishes to receive them. 

If you agree to receive these marketing communications, Turcultur may send you newsletters with our news or offers. Such offers may include information on our tickets and other associated products. 

Tracking data are collected from the email the Customer provides in order to monitor action and tailor content. This email data will only be stored for as long as the customer keeps their subscription active. 

Turcultur does not share your personal data with other companies for marketing purposes without your consent to do so.

This Privacy Policy complies with the RGPD and other applicable legislation in force regarding the processing of personal data.

How long does the personal data will be kept?

The Customer's personal data is kept in strict compliance with the applicable legislation and is stored in specific databases for this purpose:

What are the rights of the personal data subjects?

Under the terms of the applicable legislation, the data subject has the right to request, at any time and free of charge, access to personal data concerning them, as well as their rectification, deletion or limitation of processing, the portability of their data or to oppose their processing (with the exception of data strictly necessary for the provision of the service), by writing to Turcultur at the email address info@lisbonquake.com. 

You can obtain confirmation as to which personal data concerning you are being processed, as well as access to the same, with a copy of the data being made available to you on request. 

You have the right to withdraw your consent at any time, however, the withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent previously given. 

You also have the right, under the terms of the applicable legislation, to request the limitation of the processing or the portability of your data, subject to the conditions provided for by law.

Ways to use the Quake page

Not withstanding the security measures adopted by Turcultur, it is important to alert Clients to the fact that when accessing the website, they must adopt the necessary precautions and security measures, namely by using an updated computer and browser and taking care when using the computer as well as when accessing their client account, not sharing their access data with third parties.  

Turcultur shall not be held liable for the use of uncertain, incomplete or outdated personal data provided by the customer. However, Turcultur will take the appropriate measures within its power to ensure that inaccurate data, taking into account the purposes for which they are processed, are deleted or rectified without delay.  

Turcultur only guarantees the security of the data stored internally and its ownership.  

The payment page provided in our online shop is the responsibility of SIBS and Paypal.  

Thus, the data from your credit or debit card is collected by SIBS and the data from your Paypal account is collected by Paypal. Turcultur does not have access to your credit / debit card or Paypal account data.

What are the safety measures adopted by Turcultur?

Turcultur ensures the confidentiality, protection and security of customers' personal data by implementing appropriate technical and organisational measures to protect the data provided to it against any form of improper or illegitimate processing and against any accidental loss or destruction of these data. To this end, Turcultur has security systems in place to ensure the safety of personal data processed. 

Turcultur discloses a Personal Data Protection Policy to all its employees, in order to ensure that they are aware of their obligations in this area. To ensure the continued awareness of its employees, Turcultur develops training sessions for them, who undertake to not disclose to third parties or use for purposes contrary to law, any personal information of customers whose knowledge comes from the exercise of their functions.

Use of data by other entities

Turcultur may use other entities to subcontract services. In cases where such entities need access to the personal data of Clients, the processing will be carried out under the instructions of Turcultur and in its name and on its behalf.  

Turcultur shall ensure that such subcontracting entities provide sufficient guarantees for the execution of adequate technical and organisational measures so that the processing will meet the requirements of the applicable law and ensure the security and protection of the rights of the data subjects, under the terms of the subcontracting agreement concluded with said subcontracting entities. 

 Turcultur may also transmit personal data of its Clients to third parties when it considers that such transmission is necessary or appropriate:  

  1. In the light of the applicable law; 
  2. In compliance with legal obligations / court orders;  
  3. To respond to requests from public or government authorities. 

In all these situations, Turcultur undertakes to take the appropriate measures to ensure the effective protection of the personal data it processes.

Can personal data be subject to international transfers?

The provision of services by Turcultur may involve the transfer of your personal data to third countries (not belonging to the European Union or the European Economic Area). 

In such situations Turcultur will implement the necessary and appropriate measures, in light of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), to ensure the protection of personal data subject to a complete transfer, strictly complying with the legal provisions regarding the requirements applicable to such transfers, namely by informing Customers in this regard.
